Terms of Use
Welcome to 3DP MFG. These Terms create a legally binding agreement between you ("Customer" or "you") and 3DP MFG, LLC ("we," "us," or "our"). By using our website, submitting files, or placing orders, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree with any part of these Terms, you must not use our services. You represent that you are at least 18 years old and have the legal capacity to enter into binding contracts.

1. Service Description
3DP MFG provides professional 3D printing and additive manufacturing services, including:

• File analysis and validation.
• Multi-material 3D printing (SLS, FDM)
• Post-processing and finishing services (dyeing, smoothing)
• Quality inspection and packaging
• Domestic and international shipping

Service specifications, lead times, and pricing are subject to change. We reserve the right to decline any order at our discretion.

3. User Content and Design Files

3.1 File Submission
You are solely responsible for the 3D files, designs, and specifications you submit ("User Content"). You represent and warrant that:

• You own or have the right to use all submitted files.
• Your files do not infringe on any intellectual property rights.
• Your files are free from viruses, malware, or harmful code.
• You comply with all applicable laws and export regulations.


3.2 License Grant
By submitting User Content, you grant 3DP MFG a limited, non-exclusive, royalty-free license to use, reproduce, and process your files solely for the purpose of fulfilling your order and improving our services. We will not share your files with third parties except as necessary to complete your order.


3.3 File Retention
We retain your files for 90 days after order completion to facilitate reorders. After this period, files may be permanently deleted. We recommend maintaining your own backups.


3.4 Prohibited Content
You may not submit files for:

• Medical devices intended for human implantation.
• Items that violate export control regulations.
• Counterfeit goods or items infringing intellectual property rights.
• Illegal, obscene, or harmful content.
• Items designed to circumvent security measures or DRM.

4. Orders and Payment


4.1 Order Placement
All orders are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to: file quality issues, material availability, capacity constraints, or suspected fraudulent activity.


4.2 Pricing
Prices are quoted in USD and calculated based on part volume, material type, technology, post-processing options, and quantity. Pricing is subject to change without notice. Quotes are valid for 30 days from issuance.


4.3 Payment Terms
Payment is required before production begins. We accept credit cards (via Stripe) and purchase orders for approved accounts. All transactions are processed securely. You authorize us to charge the payment method provided for the total order amount, including parts, shipping, taxes, and any applicable fees.


4.4 Taxes
Sales tax will be charged where required by law. You are responsible for any additional import duties, VAT, or customs fees for international orders.


4.5 Order Finality
All orders are final upon payment. Once production begins, orders cannot be cancelled or modified. Please review your order carefully before confirming payment.

5. Production and Lead Times

5.1 Production Queues
We offer multiple production queues with varying lead times (Economy, Priority, Rush, Dedicated). Lead times are estimates based on current capacity and are not guaranteed. Production times exclude weekends and holidays.

5.2 Delays
While we strive to meet estimated lead times, delays may occur due to file issues, material shortages, equipment malfunctions, or other unforeseen circumstances. We are not liable for damages resulting from production delays.


5.3 File Approval
We reserve the right to request clarification or modifications to files that do not meet our quality standards or may result in production failures. Production will not begin until files are approved.

6. Quality Standards and Specifications

6.1 Tolerances
Parts are manufactured to industry-standard tolerances for the selected technology. Typical tolerances are ±0.3mm for SLS, and ±0.5mm for FDM. Tighter tolerances may not be achievable due to material properties and manufacturing processes.


6.2 Material Characteristics
Each material has unique properties, including surface finish, color variation, and mechanical characteristics. We cannot guarantee exact color matching or flawless surface finishes. Minor imperfections such as layer lines, support marks, or powder residue are inherent to additive manufacturing and do not constitute defects.


6.3 Design Guidelines
Parts must comply with our design guidelines for wall thickness, hole sizes, clearances, and support requirements. Parts that do not meet guidelines may fail during production or not meet expectations.

7. Shipping and Delivery

7.1 Shipping Methods
We ship via, FedEx. Shipping costs are calculated based on package weight, dimensions, destination, and service level. We are not responsible for shipping delays caused by carriers or customs.


7.2 International Shipping
International customers are responsible for all import duties, taxes, and customs fees. Packages may be subject to customs inspection and delays. We are not responsible for packages seized or rejected by customs.


7.3 Delivery
Risk of loss transfers to you upon delivery to the carrier. You must inspect packages upon receipt and report any damage or missing items within 48 hours. Claims for lost or damaged shipments must be filed with the carrier.


7.4 Address Accuracy
You are responsible for providing accurate shipping addresses. We are not liable for delivery failures due to incorrect addresses. Address corrections or reshipments will incur additional fees.

8. Returns, Refunds, and Quality Guarantee

8.1 Quality Guarantee
We guarantee that parts will be manufactured according to the submitted design files and meet our published quality standards. If a part has a manufacturing defect that makes it unusable for its intended purpose, we will reprint or refund the part at our discretion.


8.2 Defect Claims
Claims must be submitted within 7 days of delivery with photographic evidence. The following do not constitute defects:

• Normal surface texture variations (layer lines, powder texture).
• Minor cosmetic imperfections that do not affect functionality.
• Color variations within acceptable tolerances.
• Design errors in the submitted file.
• Parts that meet published tolerances but do not fit your application.

8.3 No Returns
Due to the custom nature of 3D printing, we do not accept returns for parts that meet quality standards. All sales are final. We do not offer refunds for buyer's remorse, design errors, or parts that do not meet customer expectations when they conform to specifications.


8.4 Limitation on Refunds
Refunds are limited to the cost of the defective parts only. We do not refund shipping costs, rush fees, or provide compensation for consequential damages, lost profits, or other indirect losses.

9. Intellectual Property

9.1 Your IP Rights
You retain all intellectual property rights to your submitted designs. We do not claim ownership of your User Content.


9.2 Our IP Rights
The 3DP MFG website, branding, software, and all related materials are our intellectual property. You may not copy, reproduce, or use our intellectual property without written permission.


9.3 Infringement Claims
You agree to indemnify us against any third-party claims that your User Content infringes intellectual property rights. We reserve the right to refuse orders or remove User Content if we believe it may infringe third-party rights.

10. Indemnification
You agree to indemnify, defend, and hold harmless 3DP MFG, its officers, directors, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of our services or violation of these Terms.
• Your User Content or any intellectual property infringement.
• Your violation of applicable laws or regulations.
• Any use of parts we manufacture for you.
• Your negligence or willful misconduct.

11. Disclaimers and Limitations of Liability

11.1 Service Disclaimer
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.


11.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 3DP MFG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising from your use of our services shall not exceed the amount you paid for the specific order giving rise to the claim.


11.3 Application Suitability
You acknowledge that 3D printed parts have limitations and may not be suitable for all applications, particularly structural, load-bearing, or safety-critical applications. You are solely responsible for determining whether our parts meet your requirements and for all consequences of using them.


11.4 Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk.

12. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

We implement reasonable security measures to protect your data but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

13. Export Compliance
You represent and warrant that your orders comply with all applicable export control laws and regulations, including those of the United States and your country of residence. You certify that you will not use our services to produce or export:

• Items controlled under ITAR (International Traffic in Arms Regulations).
• Items subject to EAR (Export Administration Regulations) without proper licensing.
• Items to embargoed countries or prohibited end-users.


You agree to indemnify us for any violations of export control laws arising from your orders.

14. Dispute Resolution and Governing Law

14.1 Informal Resolution
If you have a dispute with us, please contact us first to attempt an informal resolution. We are committed to resolving issues fairly and efficiently.


14.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.


14.3 Jurisdiction
Any legal action or proceeding relating to these Terms shall be brought exclusively in the federal or state courts located in the United States, and you consent to the jurisdiction of such courts.


14.4 Waiver of Class Actions
You waive any right to participate in class action lawsuits or class-wide arbitration against 3DP MFG.

15. General Provisions

15.1 Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.


15.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3DP MFG regarding our services and supersede all prior agreements.


15.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.


15.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.


15.5 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.


15.6 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, wars, strikes, equipment failures, or government actions.
